Terms of Service

Effective date: September 7, 2026

These Terms of Service ("Terms") govern your use of Draw My Tree (the "Service"), operated by Prescott Bros LLC ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility and accounts

The Service is offered only to individuals resident in the United States. By creating an account or using the Service, you represent that you are a resident of the United States and are accessing the Service from within it. We may refuse, suspend, or terminate any account we determine is established or used outside the United States.

You must be at least 13 to use the Service. You are responsible for the activity under your account and for keeping your sign-in credentials secure. Notify us promptly at contact@drawmytree.com if you suspect unauthorized use.

Your content

You retain ownership of the trees, people, stories, media, and other content you add ("Your Content"). You grant us a limited, non-exclusive license to host, store, process, display, and back up Your Content solely to operate and improve the Service for you, including generating exports and rendering your trees.

You are responsible for Your Content, including having the rights necessary to upload it and to include information about other people. When Your Content includes information about a living person, you represent that you have a lawful basis to include it. For sensitive information about a living person — such as health or cause of death, racial or ethnic origin, or religious belief — you represent that you have their explicit consent or another lawful basis, or that they have already made it public. You are responsible for responding to requests from people whose information you have added; we provide tools to hide, correct, or remove that information and will route such requests to you. See the Privacy Policy for how we handle personal information.

Acceptable use

You agree not to:

  • upload content you do not have the right to use, or that infringes someone else's rights;
  • upload unlawful, harmful, or abusive content;
  • attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or other users' data;
  • use the Service to violate the privacy or other rights of any person.

We may, at our sole discretion and without prior notice, remove or disable access to any content, and suspend, restrict, or terminate any account, that we reasonably believe violates these Terms or applicable law. For a minor violation that can be cured, we may instead ask you to remedy it first. We may preserve and disclose content and account information where we believe in good faith that doing so is necessary to comply with the law, enforce these Terms, or protect the safety of any person, and we will report content to the appropriate authorities where the law requires it. Nothing in these Terms limits any reporting obligation imposed on us by law, including the reporting of child sexual abuse material.

Subscriptions and billing

Some features, including photos and documents, sharing, and print-ready export, require the Family Plan: a monthly or annual subscription. Subscriptions are billed through Polar, our merchant of record, on a recurring basis and renew automatically until cancelled. Print-ready export of a single tree may also be bought as a one-time Keepsake Export, billed once through Polar, which unlocks that tree only and does not renew. Pricing, cancellation, and refunds are described in our Refund & Billing Policy.

Guest use

You may build a tree as a guest without an account. Guest trees are stored only in your browser, are subject to a size limit, and may be lost if you clear your browser data. To save a tree permanently you must create an account.

Availability and changes

We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may add, change, or remove features over time. We will give reasonable notice of material changes that significantly reduce core functionality you rely on.

Our intellectual property

The Service itself, including its software, design, and trademarks, belongs to Draw My Tree and its licensors. These Terms do not grant you any rights to our intellectual property other than to use the Service as permitted here.

We respect intellectual-property rights and respond to notices of alleged infringement under the U.S. Digital Millennium Copyright Act (DMCA). If you believe content on the Service infringes your copyright, send a notice to our designated agent that includes: your physical or electronic signature; identification of the copyrighted work you claim is infringed; identification of the material claimed to be infringing and enough detail to locate it (such as the tree link or a description of the item); your contact information; a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on its behalf.

We will remove or disable access to material that is the subject of a valid notice. If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notice to the same agent. We terminate the accounts of users who are repeat infringers in appropriate circumstances.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will meet your requirements or that data will always be available or accurate.

Limitation of liability

To the maximum extent permitted by law, Draw My Tree will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 100.

Nothing in these Terms excludes or limits any liability or right that cannot be excluded or limited under the law that applies to you, including your mandatory rights as a consumer. Where such law applies, the exclusions and limits in these Terms apply only to the greatest extent that law permits.

Indemnification

You agree to indemnify and hold Draw My Tree harmless from claims arising out of Your Content or your violation of these Terms or applicable law, including claims by any person whose information you added to a tree relating to your inclusion, sharing, or handling of that information.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms. On termination, the license you grant us ends, and we will delete or return Your Content as described in the Privacy Policy. Sections that by their nature should survive termination will do so, including Our intellectual property, Disclaimers, Limitation of liability, Indemnification, and Governing law.

Governing law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-laws rules. Disputes will be resolved in the courts of the State of North Carolina, United States.

Before bringing a formal claim, you agree to first contact us at contact@drawmytree.com and try to resolve the dispute informally; if it is not resolved within 60 days, either of us may proceed. Any claim relating to the Service must be brought within one year after it first arises, unless the law that applies to you does not allow such a limit.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, notify you in the app. Continued use after changes take effect means you accept the updated Terms.
